Welcome to BroTrip! These Terms of Service ("Terms") govern your use of the BroTrip website located at brotrip.travel ("Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using BroTrip, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Eligibility

You must be at least 18 years of age to use BroTrip. By using our Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Description of Service

BroTrip is a trip planning platform that helps users:

• Search for sporting events, concerts, and other live events
• Find and compare hotel accommodations
• Discover flight options
• Plan group trips with friends
• Collect and manage shared trip funds via the Trip Wallet

We aggregate information from third-party providers and provide links to their services for booking. We also facilitate group payment collection through our Trip Wallet feature (see Section 6).

4. Third-Party Services

We are not responsible for:

• The accuracy of pricing, availability, or other information from third-party providers
• The quality of products or services purchased through third-party links
• Any disputes between you and third-party providers
• Changes to third-party services, terms, or pricing

5. Affiliate Relationships

BroTrip participates in affiliate programs with various ticketing, hotel, and travel providers. We may earn commissions when you click on links and make purchases. This does not affect the price you pay. For more details, see our Affiliate Disclosure.

6. Trip Wallet & Payment Processing

BroTrip offers a "Trip Wallet" feature that allows trip organizers ("Leaders") to collect funds from group members ("Contributors") for shared trip expenses. By using the Trip Wallet, you agree to the following:

6.1 How the Trip Wallet Works

• Leaders create a Trip Wallet associated with a planned trip and invite Contributors to pay their share
• Contributors pay via credit card, debit card, or other supported payment methods through our third-party payment processor
• Collected funds are held by our payment processor until the Leader requests a payout or issues refunds
• Leaders may request a payout of collected funds to their linked bank account

6.2 Payment Processor

Payment processing services are provided by our third-party payment processor. By using the Trip Wallet, you also agree to the payment processor's terms of service and privacy policy. BroTrip does not directly process, store, or handle your credit card or banking information.

6.3 Leader Responsibilities

If you create a Trip Wallet as a Leader, you agree to:

• Use collected funds solely for the stated trip expenses
• Provide accurate trip details and cost breakdowns to Contributors
• Issue refunds to Contributors if the trip is cancelled or costs change materially
• Comply with all applicable laws regarding the collection and use of funds

6.4 Contributor Acknowledgment

If you contribute to a Trip Wallet, you acknowledge that:

• Your payment is made to the Leader's wallet, not directly to BroTrip
• BroTrip facilitates the collection but is not a party to the financial arrangement between you and the Leader
• Refund eligibility is subject to our Refund Policy

6.5 Virtual Cards

BroTrip may offer virtual payment cards to Leaders for booking trip expenses directly. Virtual cards are issued by a third-party financial institution and are subject to their terms and conditions. BroTrip acts as a facilitator and is not the card issuer.

6.6 Fees

BroTrip may charge service fees for payment processing. Any applicable fees will be clearly disclosed before you complete a transaction. Payment processor fees (e.g., credit card processing fees) may also apply.

7. User Accounts

If you create an account with BroTrip:

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information
• You must notify us immediately of any unauthorized use of your account

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated tools to scrape or collect data from the Service
• Impersonate any person or entity
• Upload malicious code or content
• Violate any applicable laws or regulations

9. Intellectual Property

The BroTrip name, logo, website design, and original content are owned by BroTrip and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Third-party trademarks, logos, and content belong to their respective owners.

10. Disclaimer of Warranties

We do not guarantee the accuracy, completeness, or reliability of any information displayed on the Service, including event details, pricing, and availability.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROTRIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Costs of substitute services
• Any damages arising from your use of or inability to use the Service
• Any damages arising from third-party services or content

Our total liability shall not exceed $100 CAD.

12. Indemnification

You agree to indemnify and hold harmless BroTrip and its owner from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for any reason, including violation of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
